Welcome to Pan Gulf. These Terms of Service ("Terms") govern your access to and use of our website, products, and services. By accessing our website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should discontinue use of our website and services.

1. Acceptance of Terms

By using the Pan Gulf website, creating an account, or placing an order, you confirm that you are at least 18 years of age or otherwise have the legal capacity to enter into a binding agreement.

2. Products and Availability

Pan Gulf makes every effort to ensure that all product descriptions, specifications, pricing, images, and availability are accurate. However, errors may occasionally occur.

We reserve the right to:

  • Correct pricing, product descriptions, or other inaccuracies at any time.

  • Modify, update, or discontinue products without prior notice.

  • Refuse or cancel any order resulting from incorrect pricing, product information, or availability.

Product images are provided for illustrative purposes only. Actual colours, finishes, textures, and materials may vary slightly due to lighting conditions, photography, display settings, and the natural characteristics of materials.

3. Pricing and Payment

All prices are displayed in the applicable local currency unless otherwise stated.

Payment must be successfully completed before an order enters production or processing.

Pan Gulf reserves the right to refuse, suspend, or cancel any order if payment authorization cannot be obtained or fraudulent activity is suspected.

4. Order Acceptance

Submission of an order does not constitute acceptance by Pan Gulf.

Orders are deemed accepted only after payment has been successfully processed and an order confirmation has been issued.

Pan Gulf reserves the right to refuse or cancel any order for reasons including, but not limited to:

  • Product unavailability

  • Pricing or typographical errors

  • Payment verification issues

  • Suspected fraudulent activity

  • Delivery restrictions or service limitations

Where payment has already been received, any approved cancellation will be processed in accordance with the Pan Gulf Refund & Return Policy.

5. Customized Products

Customized, made-to-order, or specially manufactured products are produced according to the customer's requested specifications.

Once production has commenced:

  • Orders cannot be cancelled.

  • Customized products are non-returnable and non-refundable except where they are damaged or defective upon delivery.

Customers are solely responsible for reviewing and confirming all measurements, colours, materials, finishes, and specifications before placing a customized order.

6. Delivery

Estimated delivery dates are provided as a guideline only.

Although Pan Gulf makes every reasonable effort to deliver orders within the estimated timeframe, delivery dates are not guaranteed and may be affected by manufacturing schedules, supplier delays, customs clearance, transportation issues, weather conditions, or events beyond our reasonable control.

Customers are responsible for ensuring that someone is available to receive the order at the agreed delivery address.

Additional delivery charges may apply to remote or restricted delivery locations.

7. Inspection Upon Delivery

Customers should inspect all products immediately upon delivery.

Any visible damage, missing items, or incorrect products must be reported within the timeframes specified in the Pan Gulf Refund & Return Policy.

Failure to report such issues within the applicable period may affect eligibility for a replacement, repair, or refund.

8. Returns and Refunds

All returns, exchanges, cancellations, and refunds are governed by the Pan Gulf Refund & Return Policy.

By placing an order, customers acknowledge that they have read, understood, and agreed to the applicable return and refund conditions.

9. Warranty

Pan Gulf is committed to supplying furniture manufactured to high standards of quality, durability, and craftsmanship.

5-Year Structural Warranty

Pan Gulf provides a 5-Year Structural Warranty on eligible furniture products against defects in structural integrity arising from faulty materials or workmanship under normal residential use.

The structural warranty covers:

  • Internal frames

  • Structural joints

  • Load-bearing components

  • Manufacturing defects affecting the stability or structural performance of the furniture

If a valid structural defect occurs during the warranty period, Pan Gulf may, at its sole discretion:

  • Repair the product;

  • Replace the defective component or the entire product with the same or a comparable model; or

  • Provide another appropriate remedy where repair or replacement is not reasonably possible.

Warranty Exclusions

The warranty does not cover:

  • Normal wear and tear.

  • Cosmetic damage, including scratches, dents, fading, discoloration, fabric pilling, or finish deterioration resulting from regular use.

  • Damage caused by misuse, abuse, negligence, accidents, improper assembly, improper installation, or improper maintenance.

  • Damage resulting from exposure to excessive moisture, direct sunlight, heat sources, chemicals, or environmental conditions.

  • Commercial, rental, hospitality, office, or institutional use unless otherwise agreed in writing.

  • Damage resulting from unauthorized repairs, alterations, or modifications.

  • Upholstery fabrics, leather, foam softening, stitching, cushions, glass, marble, stone, veneers, paint finishes, hardware, or any non-structural components unless determined by Pan Gulf to be defective upon delivery.

Warranty Claims

To submit a warranty claim, customers must provide:

  • Original proof of purchase.

  • Clear photographs and/or videos showing the defect.

  • A detailed description of the issue.

Pan Gulf reserves the right to inspect the product before approving any warranty claim.

This warranty applies only to the original purchaser and is non-transferable unless otherwise required by applicable law.

This warranty is provided in addition to any statutory rights available under applicable consumer protection legislation.

10. Customer Responsibilities

Customers agree to:

  • Provide accurate billing, shipping, and contact information.

  • Verify measurements and product specifications before placing an order.

  • Follow all care, maintenance, and usage instructions supplied with the product.

  • Use all products safely and only for their intended purpose.

11. Intellectual Property

All content available on the Pan Gulf website, including but not limited to text, graphics, photographs, logos, product designs, software, videos, trademarks, and other intellectual property, is owned by or licensed to Pan Gulf and is protected under applicable intellectual property laws.

No content may be copied, reproduced, distributed, modified, published, or used without prior written permission from Pan Gulf.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Pan Gulf shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the use of our website, products, or services.

Pan Gulf's total liability for any claim shall not exceed the amount paid by the customer for the affected order.

Nothing in these Terms excludes or limits liability where such exclusion is prohibited by law.

13. Force Majeure

Pan Gulf shall not be liable for delays or failure to perform its obligations resulting from circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, labour disputes, transportation interruptions, supplier shortages, governmental actions, war, civil unrest, or other force majeure events.

14. Privacy

Customer information is collected, processed, stored, and protected in accordance with the Pan Gulf Privacy Policy.

By using our website, customers consent to such collection and processing.

15. Fraud Prevention

Pan Gulf reserves the right to verify customer identity, payment details, billing information, and delivery addresses before processing any order.

Orders suspected of fraudulent or unauthorized activity may be delayed, cancelled, or referred to the relevant authorities where appropriate.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of the United Arab Emirates, unless otherwise required by applicable law.

17. Amendments to These Terms

Pan Gulf reserves the right to amend or update these Terms of Service at any time without prior notice.

Any revised Terms become effective immediately upon publication on the website. Continued use of the website following such publication constitutes acceptance of the updated Terms.
